Bulletin summary

An amended Environmental Compliance Approval (air) with Limited Operational Flexibility was issued to Jems Coating Limited, an automotive components coating facility located in the City of Vaughan, Ontario. The amendment includes the addition of a new powder coating line and odour control equipment for the two existing e-coat baking ovens.

Why consultation isn't required

On April 1, 2020, the Ontario Government made a temporary regulation to respond to the COVID-19 outbreak. Ontario Regulation 115/20 exempted all proposals for policies, acts, regulations and instruments from posting requirements under the EBR.

Ontario Regulation 115/20 was revoked on June 15, 2020, however, we are posting this decision as a bulletin because the proposal was posted on April 20, 2020, while Ontario Regulation 115/20 was in effect.

Although consultation was not required, the ministry did consult with the public on this proposal by posting ERO# 019-1597  for public comment from April 06, 2020 to May 21, 2020. To ensure transparency, the ministry is providing details of its decision and the effects of consultation on decision-making in this notice.

Instrument decision details

An amendment to the Limited Operational Flexibility for an Environmental Compliance Approval (air) 6524-84HL58 was issued to Jems Coating Limited, an automotive components coating facility located in the City of Vaughan, Ontario.

The amendment includes the addition of a powder coating line equipped with pre-treatment, dry-off oven, powder paint booth, and ovens and an Ecolo Odour Control Vaporization system on each of the 2 e-coat baking ovens to reduce odour emissions.

The proposal was submitted in conjunction with Air and Noise Application - Ministry Reference No. 5209-BMMRCR (ERO Number 019-1297).

Effects of consultation

No comments were received.

Third parties are not able to apply for leave to appeal in respect of proposals which were posted while Ontario Regulation 115/20 was in effect between April 1, 2020 and June 14, 2020. Ontario Regulation 115/20 exempted all proposals for instruments from posting requirements under the EBR. Leave to appeal may only be sought in respect of instruments that are required to be posted to the ERO.
