Bulletin summary

An amended Environmental Compliance Approval (waste disposal site) No. A371203 is granted to Waste Management of Canada Corporation to allow for construction of modified leachate storage system at the Richmond Landfill.

Why consultation isn't required

On April 1, 2020, the Ontario Government made a temporary regulation to respond to the COVID-19 outbreak. Ontario Regulation 115/20 exempted all proposals for policies, acts, regulations and instruments from posting requirements under the EBR.

Ontario Regulation 115/20 was revoked on June 15, 2020, however, we are posting this decision as a bulletin because the proposal was posted on May 22, 2020 while Ontario Regulation 115/20 was in effect.

Although consultation was not required, the ministry did consult with the public on this proposal by posting ERO# 019-1803 for public comment from May 22, 2020 to July 6, 2020. To ensure transparency, the ministry is providing details of its decision and the effects of consultation on decision-making in this notice.

Instrument decision

This decision approves the construction of modified leachate storage system at the Richmond Landfill, owned and operated by Waste Management of Canada Corporation.

The site is located at 1271 Beechwood Road, Town of Greater Napanee, County of Lennox and Addington. The landfill has an approved fill area of 16.2 hectares within a property of 138.0 hectares.

The landfill ceased to accept waste on June 30, 2011 and is maintained regularly during the post closure period. The site used to service the Province of Ontario but is now closed to the public.

The proposed leachate storage system modifications include:

  • enlarged storage tank having capacity of 3,000 cubic metres
  • revised truck loading facility with pumping station PS3

These modifications will allow for safe storage of extra leachate, particularly during high flow periods when access to the closest treatment facility in Napanee is restricted. The additional storage volume would also reduce leachate spill potential at the site.

No changes to tonnages, service area or hours of operation are requested under this proposal.

No comments were received during the commenting period.

Effects of consultation

Public comments submitted to the ministry outside the ERO commenting period were considered and addressed by the proponent prior to issuance of the ECA.

Third parties are not able to apply for leave to appeal in respect of proposals which were posted while Ontario Regulation 115/20 was in effect between April 1, 2020 and June 14, 2020. Ontario Regulation 115/20 exempted all proposals for instruments from posting requirements under the EBR. Leave to appeal may only be sought in respect of instruments that are required to be posted to the ERO.
