Why consultation isn't required
The ministry has relied on section 30 of the Environmental Bill of Rights, 1993 (EBR), as it is the director’s opinion that the environmentally significant aspects of this proposal have already been considered in a process of public participation that was substantively equivalent.
The environmentally significant aspects of this decision were consulted on through:
- a previous registration for ARLANXEO Canada Inc. (012-9942)
- the development of the Petrochemical - Industry Standard (012-6859)

The ministry is posting this exemption notice to give notice of its decision to rely on section 30 of the EBR.

Registration details for Diamond Petrochemicals Canada Corporation
We have granted approval for Diamond Petrochemicals Canada Corporation (Diamond) to register under the Technical Standards Registry – Air Pollution (Technical Standards Registry) in respect of the Petrochemical – Industry Standard under the Local Air Quality Regulation (O. Reg. 419/05).
Diamond is a petrochemical manufacturing facility located at 1265 Vidal Street in Sarnia, Ontario. The facility is part of a class identified by the primary North American Industry Classification System code 325110 Petrochemical Manufacturing. The facility is registered for 1,3 butadiene. Registration is for all petrochemical sources that emit 1,3 butadiene.
Registration to the Technical Standards Registry
Registration to a technical standard means that this facility must adhere to all technical and operational requirements in the Petrochemical – Industry Standard (see link on the right-hand side of this notice) for the contaminants for which they are registered.
Technical standards ensure that facilities are managing impacts on the airshed by installing best available technology. These requirements replace the air standards for the contaminants that they are registered for this facility.
Registration to the Technical Standards Registry is a compliance approach under the Local Air Quality Regulation. It requires the company to demonstrate compliance on an ongoing basis through applicable technical standards requirements set out in the Petrochemical - Industry Standard.
Registration to the Technical Standards Registry does not exempt a facility from the requirements under section 9 of the Environmental Protection Act, which regulates alterations to plant infrastructure and processes. Therefore, a company required to install equipment under the Petrochemical – Industry Standard is still required to have approval under Part II.1 of the Ontario Environmental Protection Act for that equipment.
The Technical Standards Registry is available on the Ministry of the Environment, Conservation and Parks' website and sets out the names of all facilities registered in the Registry.
Exemption details:
We considered the following factors in exempting this registration from public consultation:
- this decision is to facilitate the transfer of 1,3 butadiene production and handling from ARLANXEO Canada Inc. (ARLANXEO) to Diamond
- Diamond has requested to register under the Petrochemical - Industry Standard for the sources of 1,3 butadiene that were transferred to them from ARLANXEO
- ARLANXEO registered to the Petrochemical Industry Standard for 1,3 butadiene on July 28, 2017 (012-9942); the proposal was posted for 45 days on May 24, 2017 and all comments were considered in the decision
- the environmentally significant aspects of this decision were consulted on as part of the ARLANXEO registration and during the development of the Petrochemical - Industry Standard (012-6859)
