Why consultation isn't required
On April 1, 2020, the Ontario Government made a temporary regulation to respond to the COVID-19 outbreak. Ontario Regulation 115/20 exempted all proposals for policies, acts, regulations and instruments from posting requirements under the EBR.
Ontario Regulation 115/20 was revoked on June 15, 2020, however, we are posting this decision as a bulletin because the proposal was posted on May 22, 2020 while Ontario Regulation 115/20 was in effect.
Although consultation was not required, the ministry did consult with the public on this proposal by posting ERO# 019-1798 for public comment from May 22, 2020 - July 6, 2020. To ensure transparency, the ministry is providing details of its decision and the effects of consultation on decision-making in this notice.

Instrument decision
Safety-Kleen Canada Inc. submitted an Environmental Compliance Approval Application (ECA) to the Ministry of the Environment, Conservation and Parks (MECP) to amend the Environmental Compliance Approval (ECA) No. A220249 for the existing Safety-Kleen waste transfer facility located at 25 Regan Road, Brampton, ON.
The site has been operating since 1992 and is currently used for the temporary storage and transfer of waste materials from various customers, together with an operation for oil filter processing. The site services and accepts waste that is only generated within the geographical boundary of Canada and the United States of America. The site is permitted to operate 24 hours per day, seven days per week.
The amendment relates to the maximum number of waste bins that can be stored outside at the site. The ECA allowed the site to store up to two bins of non-hazardous waste outside. The site utilizes these bins for the storage of non-hazardous scrap metal that is a by-product of the site’s oil filter crusher. This condition has now been amended to allow for the outside storage of up to five bins of non-hazardous scrap metal waste. The bins will be lugger bins, roll-off bins, or both.
Current waste operations at the facility remain unchanged including the waste analysis plan.

Effects of consultation
Since we did not receive any comment during the commenting period, there is no impact of comment on the approval.
Third parties are not able to apply for leave to appeal in respect of proposals which were posted while Ontario Regulation 115/20 was in effect between April 1, 2020 and June 14, 2020. Ontario Regulation 115/20 exempted all proposals for instruments from posting requirements under the EBR. Leave to appeal may only be sought in respect of instruments that are required to be posted to the ERO.
