Why consultation isn't required
Part II of the Environmental Bill of Rights Act, 1993 does not apply to proposal to make a Minister's Zoning Order (MZO) under subsection 47(1) of the Planning Act, or to amend or revoke an MZO under subsection 47(8) of the Planning Act.

A Zoning Order, made pursuant to clause 47(1)(a) of the Planning Act, regulates the use of land and the erection, location and use of any building or structure on the land. The Minister’s Zoning Order was made based on a request from the Township of McNab/Braeside.
Ontario Regulation 538/21 will facilitate a proposed manufacturing/industrial assembly plant that designs and builds agricultural buildings. Ontario Regulation 538/21 applies to approximately 18 ha (44 acres) of land located at 2424 Russett Drive in the Township of McNab/Braeside. The lands are legally described as Part of Lot 17, Concession 8, which are also identified on Map 268, filed at the Ministry of Municipal Affairs & Housing.

Pursuant to subsection 47 (4) of the Planning Act, and except for the purposes of section 24, the Minister deemedO. Reg. 538/21 to be and to always have been a by-law passed by the Council of the Township of McNab/Braeside.
