Decision details

The Minister of Natural Resources and Forestry has decided to approve an amendment to the Niagara Escarpment Plan to change the land use designation of the lands found at Part Lot 6, Concession 4, 3475 Campbellville Road in the Town of Milton, Region of Halton from Mineral Resource Extraction Area to Escarpment Protection Area. The 24.2 ha (59.8 ac) subject lands are currently designated Mineral Resource Extraction Area in the Niagara Escarpment Plan, in conjunction with a sand and gravel pit extraction operation that was established in the 1960’s and licensed under the Aggregate Resources Act (ARA).

The extraction activities have ceased, the site has been rehabilitated, and the licence has been surrendered. The subject lands are being re-designated to Escarpment Protection Area, consistent with the Land Use Designation Criteria and Objectives in the NEP.

Effects of consultation

The only public comment to the amendment was received through the Environmental Registry, and simply stated support for the proposal. Comments from the municipality, region and conservation authority were supportive. No changes to the proposal were made.

The approximately 24.18 ha (59.76 ac) subject lands are currently designated Mineral Resource Extraction Area in the Niagara Escarpment Plan (NEP), in conjunction with a sand and gravel pit extraction operation that was established in the 1960’s (pre-dating the NEP) and Development Control).

The extraction activities have ceased, the site has been rehabilitated, and the licence has been surrendered. The subject lands are being proposed to be re-designated to Escarpment Protection Area, consistent with the Land Use Designation Criteria and Objectives in the NEP).

Public consultation opportunities

Sections 7 and 10 (1) of the Niagara Escarpment Planning and Development Act requires that affected ministries and municipalities be provided with advance notice of the proposed amendment. The Niagara Escarpment Commission (NEC) will do so via direct email/mail and a posting on the NEC website. The proposal will also be posted in a local newspaper (Milton Champion), inviting comment. Additionally, landowners within 120 m of the subject property will be notified via direct mail and invited to comment.
