Why consultation isn't required
Part II of the Environmental Bill of Rights Act, 1993 does not apply to proposal to make a Minister's Zoning Order (MZO) under subsection 47(1) of the Planning Act, or to amend or revoke an MZO under subsection 47(8) of the Planning Act.
A Zoning Order, made pursuant to clause 47(1)(a) of the Planning Act, regulates the use of land and the erection, location and use of any building or structure on the land.
O. Reg. 783/21 provides relief from certain zoning requirement to facilitate the development of an industrial employment area and various farm-related uses. This order also includes the protection of a watercourse and woodlot.
O. Reg. 783/21 applies to lands municipally known as 6332 Perth Road 131, in the Township of Perth East. For illustrative purposes, the subject lands are shown in reference map 275, the link to which is set out below.
Pursuant to subsection 47(4) of the Planning Act, and except for the purposes of section 24, the Minister deemed O. Reg. 783/21 to be and to have always been a by-law passed by the Council of the Township of Perth East.
