Decision details

The new Official Plan (OP) for the Township of Hornepayne adopted on December 8, 2021 by By-law No. 1895 was approved as modified on April 6, 2022. Four (4) modifications were required to ensure that the Official Plan has regard for provincial interests as set out in Section 2 of the Planning Act and to ensure consistency with the 2020 Provincial Policy Statement (PPS). The new Official Plan provides appropriate localized policy direction for the management and protection of water resources, endangered species and wildlife habitat, and environmentally sensitive areas. The OP also includes policies to guide waste management, and manage the risks associated with various natural hazards.

Of the four (4) modifications, three are specifically related to the environment.

For consistency with MECP’s D-series land use planning guidelines, and PPS policy 1.6.6.4 (long-term provision of services with no negative impacts), modification number 2 clarifies that for individual onsite water and sewage services (class IV septic system) the minimum lot size is 1 ha. Modification number 4 adds further details and clarity as to when a hydrogeological assessment may be required to support a consent application, as per MECP’s D-series guidelines for individual onsite water and sewer systems and for consistency with PPS Policy 1.6.6.4.

For consistency with PPS policies 3.1.4 and 3.1.7, modification number 3 clarifies that minor additions and or renovations to existing buildings in a flood plain are only permitted where they do not affect flood flows.

Other Information

Pursuant to subsections 17 (36.5) and (38.1) of the Planning Act, this decision is final and not subject to appeal.

Proposal details

The Township of Hornepayne adopted the proposed official plan on December 8, 2021 by By-law No. 1895. The plan will replace the existing Official Plan which was adopted on February 14, 1978 by the Council of Wicksteed Township. The plan will provide guidance and direction for development and planning decisions within the Township of Hornepayne to the 2046 planning horizon. The proposed plan will be reviewed for consistency with the Provincial Policy Statement and matters of provincial interest, as expressed in the Planning Act. This includes the protection of ecological systems, conservation and management of natural resources, supply of affordable housing, efficient land use, conservation of energy and water, waste management, climate change mitigation and adaptation, among other interests. The proposed official plan is a result of the Township of Hornepayne’s review of its current plan, as required under section 26 of the Planning Act.

The adopted official plan has been forwarded to the Ministry of Municipal Affairs and Housing by the Township of Hornepayne for a decision. Pursuant to subsections 17(36.5) and (38.1) and subsection 21(3) of the Planning Act, the decision of the Minister of Municipal Affairs and Housing regarding an official plan adopted in accordance with section 26 is final and not subject to appeal.
