Decision details

A decision was made on April 11, 2023, 2023 to approve, with twenty-four (24) modifications, the City of Belleville new official plan as adopted pursuant to sections 17 and 26 of the Planning Act by City of Belleville By-law 2021-180. Notice of this decision was issued on April 11, 2023, to the City of Belleville.

The adopted official plan was reviewed for consistency with provincial policies and has regard for matters of provincial interests as outlined in the Planning Act. The twenty-four (24) modifications to the official plan have been made to address matters related to conformity with the Planning Act, the protection of natural heritage resources and drinking water, and housing supply.

The approval of the City of Belleville’s new official plan, as modified, outlines a comprehensive land use policy framework to guide growth and development within the city to the year 2038, including policies and schedules related to housing; planning for employment and infrastructure; environmental and agricultural protection; and public health and safety, among other matters.

Pursuant to subsections 17 (36.5) and (38.1) of the Planning Act, the decision of the Minister of Municipal Affairs and Housing regarding an official plan adopted in accordance with section 26 is final and not subject to appeal. Accordingly, the new City of Belleville Official Plan, as approved with modifications by the Minister, came into effect on April 11, 2023.

The new official plan applies to all lands within the City of Belleville.

Effects of consultation

Public comments received by the Ministry expressed interests related to growth management and natural heritage policy and mapping.

Natural heritage features and areas are identified and protected through Official Plan text, schedules and appendices. Further, the Official Plan requires consideration for the impact of trails on adjoining sensitive land uses (including private properties) and, where necessary, to incorporate mitigative measures or trail relocation. One comment resulted in modification to protect fish habitat in accordance with the Provincial Policy Statement, 2020.

One comment resulted in a modification to expand the urban boundary. Another comment resulted in a modification to convert certain site-specific lands in the urban area from an employment designation to residential. All comments were reviewed and taken into consideration, prior to a decision being made.

Proposal details

The City of Belleville adopted the proposed official plan on November 8, 2021 by By-law No. 2021-180. The plan will replace the existing Official Plan which was adopted on January 7, 2002, save and except for the Loyalist Secondary Plan. The plan will provide guidance and direction for development and planning decisions within the City of Belleville to the 2038 planning horizon. The proposed plan will be reviewed for consistency with the Provincial Policy Statement and matters of provincial interest, as expressed in the Planning Act. This includes the protection of ecological systems, conservation and management of natural resources, supply of affordable housing, efficient land use, conservation of energy and water, waste management, climate change mitigation and adaptation, among other interests. The proposed official plan is a result of the City of Belleville’s review of its current plan, as required under section 26 of the Planning Act.

The adopted official plan has been forwarded to the Ministry of Municipal Affairs and Housing by the City of Belleville for a decision. Pursuant to subsections 17(36.5) and (38.1) and subsection 21(3) of the Planning Act, the decision of the Minister of Municipal Affairs and Housing regarding an official plan adopted in accordance with section 26 is final and not subject to appeal.
