Bulletin summary

Tartan JTJ Homes Inc. has withdrawn its application for a permit to authorize construction of 82 stacked townhome units in Ottawa, Ontario that would have impacted Butternut and its habitat. As a result, no permit has been issued.

Why consultation isn't required

On April 1, 2020, the Ontario Government made a temporary regulation to respond to the COVID-19 outbreak. Ontario Regulation 115/20 exempted all proposals for policies, acts, regulations and instruments from posting requirements under the EBR.

Ontario Regulation 115/20 was revoked on June 15, 2020, however, we are posting this decision as a bulletin because the proposal was posted on May 22, 2020 while Ontario Regulation 115/20 was in effect.

Although consultation was not required, the ministry did consult with the public on this proposal by posting ERO # 019-1504 for public comment from May 22, 2020 to June 21, 2020. To ensure transparency, the ministry is providing details of the outcome and the effects of consultation on decision-making in this notice.

Instrument decision

Tartan JTJ Homes Inc. (the proponent) applied for an overall benefit permit under clause 17(2)(c) of the Endangered Species Act, 2007 (ESA). The proposal was to construct 82 stacked townhome units on Greenbank Road in the City of Ottawa. This activity would impact Butternut trees, which is a species at risk.

On January 17, 2022, the proponent withdrew its overall benefit application and therefore no decision will be made on the application. No permit was issued.
