Why consultation isn't required
Part II of the Environmental Bill of Rights Act, 1993 does not apply to proposals to make a Minister's Zoning Order (MZO) under subsection 47(1) of the Planning Act, or to amend or revoke an MZO under subsection 47(8) of the Planning Act.
Bulletin details
A Zoning Order, made pursuant to clause 47(1)(a) of the Planning Act, regulates the use of land and the erection, location and use of any building or structure on the land.
O. Reg. 156/22 provides relief from certain zoning requirements to facilitate the development of warehouse and office uses, to help create thousands of jobs to support the local economy hard-hit by the COVID-19 pandemic. This order also includes the protection of environmentally sensitive natural heritage features and natural hazards located on the subject lands.
O. Reg. 156/22 applies to lands municipally known as 11260 and 11424 Jane Street in the City of Vaughan. For illustrative purposes, the subject lands are shown in the map, the link to which is set out below.
Pursuant to subsection 47(4) of the Planning Act, and except for the purposes of section 24, the Minister deemed O. Reg. 156/22 to be and to always have been a by-law passed by the Council of the City of Vaughan.
