Why consultation isn't required
Part II of the Environmental Bill of Rights Act, 1993 does not apply to proposals to make a Minister's Zoning Order (MZO) under subsection 47(1) of the Planning Act, or to amend or revoke an MZO under subsection 47(8) of the Planning Act.
Bulletin details
A Zoning Order, made pursuant to clause 47(1)(a) of the Planning Act, regulates the use of land and the erection, location and use of any building or structure on the land.
O. Reg. 249/22 provides relief from certain zoning requirements to facilitate the redevelopment (full replacement) of the Mississauga Hospital to allow for a 22-storey hospital with over 950 patient beds.
Additional accessory uses include: a long-term care building, a retirement building, supportive housing, hospice, overnight accommodation, banquet hall/convention centre/conference centre, education and training facility, and science and technology facility.
O. Reg. 249/22 applies to lands municipally known as 100 Queensway West and 2250 Hurontario Street in the City of Mississauga.
Pursuant to subsection 47(4) of the Planning Act, and except for the purposes of section 24, the Minister deemed O. Reg. 249/22 to be and to always have been a by-law passed by the Council of the City of Mississauga.
