Why consultation isn't required
Part II of the Environmental Bill of Rights Act, 1993 does not apply to proposals to make a Minister's Zoning Order (MZO) under subsection 47(1) of the Planning Act, or to amend or revoke an MZO under subsection 47(8) of the Planning Act.
Bulletin details
A Zoning Order, made pursuant to clause 47(1)(a) of the Planning Act, regulates the use of land and the erection, location and use of any building or structure on the land.
O. Reg. 331/22 and O. Reg. 332/22 provides permissions for a range and mix of residential, commercial, and institutional uses to support the development of a Transit-Oriented Community. Specifically, O. Reg. 331/22 provides for a maximum gross floor area of 17,252 square metres. O. Reg. 332/22 provides for a maximum gross floor area of 24,658 square metres.
O. Reg. 331/22 applies to lands located at the north-east corner of King Street West and Bathurst Street, in Toronto.
O. Reg. 332/22 applies to lands located at the south-east corner of King Street West and Bathurst Street, in Toronto.
The lands subject to O. Reg. 331/22 are described as:
lands in the City of Toronto, in the Province of Ontario being the lands described as:
- Lots 3-6; part of Lots 2 and 9; and part Lane on Registered Plan D41 (Toronto) as identified by Property Identification Number 21239-0156 (LT) registered in the Land Registry Office for the Land Titles Division of Toronto (No. 80); and
- Lot 1; and part of Lot 2 on Registered Plan D41 as identified by Property Identification Number 21239-0157 (LT) registered in the Land Registry Office for the Land Titles Division of Toronto (No. 80).
The lands subject to O. Reg. 332/22 are described as:
lands in the City of Toronto, in the Province of Ontario, being the lands described as part of Lot 6 Section M, on Registered Plan Military Reserved, as identified by Property Identification Number 21240-0309 (LT) registered in the Land Registry Office for the Land Titles Division of Toronto (No. 80).
Pursuant to subsection 47(4) of the Planning Act, and except for the purposes of section 24, the Minister deemed O. Reg. 331/22 and O. Reg. 332/22 to be and to always have been a by-law passed by the Council of the City of Toronto.
