Application 58-C-217997 was approved on September 28, 2022 subject to the following conditions:

  1. That this approval applies to permit to the severance of 38.46 hectares from PIN 62318-0041 to be added as a lot addition to PIN 62318-0040 while 11.51 ha would be retained, as applied for, in the above noted location in geographic township of Forbes in the District of Thunder Bay.
  2. That the following documents be provided for the transaction described in Condition 1:
    1. A copy of the application to transfer documents;
    2. A schedule to application to transfer on which is set out the entire legal description of the parcel(s) in question.  This Schedule must also contain the names of the parties indicated on application to transfer; and
    3. A reference plan of survey, which bears the Land Registry Office registration number and signature as evidence of its deposit therein, illustrating the parcel(s) to which the consent approval relates; and/or a legal description of the lands to be severed which is acceptable to the land registrar.
  3. That the application to consolidate the parcels be prepared and an undertaking from the person registering the documents shall be required agreeing to register the consolidations once the land transfers have been registered.
  4. That prior to final approval, the Ministry must be advised by the Thunder Bay District Health Unit that the retained lands; and the severed lands, together with PIN 62318-0040 have been inspected and are suitable for the installation of a subsurface sewage system or that the existing systems meet their requirements.
  5. That prior to final approval, this Ministry is to be provided written confirmation of adequate capacity to dispose of hauled sewage generated by the severed and retained lands. This written confirmation should take the form of a letter from the holder of an Environmental Compliance Approval (ECA) for an approved septage disposal facility, referencing the disposal facility and the related Ministry of the Environment, Conservation and Parks (MECP) approval, and confirming that the disposal facility has sufficient reserve capacity to accept hauled sewage from the proposed lots.

The last date to appeal this decision under the Planning Act is October 18, 2022.

Proposal details

The purpose of this application 58-C-217997 is to sever an irregularly shaped portion of land approximately 38.46 hectares from PIN 62318-0041 to be added to the abutting PIN 62318-0040. The proposed severed lot is approximately 38.46 hectares with 37.5 metres of frontage on the road and a depth of 787.49 metres. The retained lands would be approximately 11.51 hectares with 552.78 metres of frontage and 288.87 metres of depth. The land receiving the addition is currently 12.14 hectares with 198 metres of frontage and 441.2 metres of depth. The lands to be transferred are currently and proposed to be vacant while the retained lands contain a house and garage. The lands receiving the addition currently contain an aging house which is not serviced with plumbing or hydro, and the purpose of the addition is for the applicant to secure the appropriate lumber stock to mill lumber and build a new house.
