On November 4, 2022, the Minister of Municipal Affairs and Housing filed a Zoning Order with the Registrar of Regulation as Ontario Regulation 515/22 to permit the development of over 500 housing units, including apartments, townhouses, a retirement facility, and hospice, as well as a future employment area in the Municipality of Brockton

 

Why consultation isn't required

Part II of the Environmental Bill of Rights Act, 1993 does not apply to proposals to make a Minister's Zoning Order (MZO) under subsection 47(1) of the Planning Act, or to amend or revoke an MZO under subsection 47(8) of the Planning Act.

Bulletin details

A Zoning Order, made pursuant to subsection 47(1) of the Planning Act, regulates the use of land and the erection, location and use of any building or structure on the land. The Minister's Zoning Order was made based on a request from the Municipality of Brockton.

O. Reg. 515/22 facilities the development of over 500 housing units, including apartments, townhouses, a retirement facility, and hospice, as well as a future employment area.

O. Reg. 515/22 applies to approximately 24 hectares of land legally described as Part of Park Lots 47 and 48, on Registered Plan 162, Part of Lots 32-35, Concession 1, North of Durham Road (Brant), Municipality of Brockton, County of Bruce. See Location Map below.

Pursuant to subsection 47(4) of the Planning Act, and except for the purposes of section 24, the Minister deemed O. Reg. 515/22 to be and to always have been a by-law passed by the council of the Municipality of Brockton.
