Why consultation isn't required
The Ministry of Natural Resources and Forestry (MNRF) has implemented Section 30(1) of the Environmental Bill of Rights, 1993 (EBR) to post an exception notice. Environmentally significant aspects of the land use amendment proposal have already been considered in a process of public participation under the EBR that was substantially equivalent to the process required for this proposal.
Equivalent public participation occurred through Ontario Parks’ (Ministry of the Environment, Conservation and Parks) consultation on an associated conservation reserve boundary regulation proposal notice number 019-4597. This notice included a link to MNRF’s Crown Land Use Policy Atlas (CLUPA) where the proposed Crown land use amendment, including a map and policy report, could be viewed, and commented on (Amendment #2021-001).
Exception details
Description of the proposal
A major amendment to land use policy under the Public Lands Act was required to redesignate the subject Crown Lands as recommended conservation reserve.
The area proposed for a Crown land use amendment totaled approximately 1,607 hectares (ha) consisting of:
- Point Petre Provincial Wildlife Area, including Charwell Point
- Ostrander Point Crown Land Block
- the adjacent bed of Lake Ontario, generally to a distance of 30 m from the shoreline, except at Charwell Point where the distance is extended to 200 m
Consultation
A regulation proposal notice was posted by Ministry of the Environment, Conservation and Parks (MECP) through the Environmental Registry of Ontario on January 26, 2022, for a 45-day comment period ending March 12, 2022. The notice outlined the proposed regulation and included a link to CLUPA where the proposed Crown land use amendment, including a map and policy report, could be viewed, and commented on (Amendment #2021-001).
Direct notification and opportunity to comment on the proposal was provided to Indigenous communities, public and stakeholders through direct mailing to the local stakeholders, media ads in local newspapers, social media posts and a printed notice posted at Sandbanks Provincial Park.
All comments received related to the regulatory proposal have been considered applicable to the land use amendment.
99 comments were received from Indigenous communities, the public and stakeholders during the comment period. Most respondents were supportive of the proposal.
Based on comments received, a 13-ha strip of Crown land north of Army Reserve Road in Lots 6, 7 and 8, Block 15, is no longer considered part of to the Crown land use amendment. The land was not included in the boundary of the recommended conservation reserve.
No other changes to the Crown land use amendment proposal were made because of consultation.
Decision on the proposal
Amendments to land use policy under the Public Lands Act were made to designate the Crown land as recommended conservation reserve, effective September 15, 2022.
An amendment to Ontario Regulation 315/07 under the Provincial Parks and Conservation Reserves Act, 2006 to establish a new conservation reserve along the south shore of Prince Edward Country is still under consideration by MECP.
