Bulletin summary

On December 22, 2022, the Minister of Affairs and Housing filed a Zoning Order with the Registrar of Regulations as Ontario Regulation (O. Reg.) 592/22 to accelerate a mixed-use, transit-oriented development to permit a range of residential, commercial, and institutional uses.

Why consultation isn't required

Part II of the Environmental Bill of Rights Act, 1993 does not apply to proposals to make a Minister's Zoning Order (MZO) under subsection 47(1) of the Planning Act, or to amend or revoke an MZO under subsection 47(8) of the Planning Act.

Bulletin details

A Zoning Order, made pursuant to clause 47(8) of the Planning Act, regulates the use of the land and the erection, location and use of any building or structure on the land. The Minister's Zoning Order was made based on a request from the City of Niagara Falls.

O. Reg. 592/22 facilitates a mixed-use, transit-oriented development on lands adjacent to the Niagara Falls GO Station and Niagara Falls Bus Station. This would include approximately 1,700 new housing units, along with a range of commercial and institutional uses.

O. Reg. 592/22 applies to approximately 5.5 hectares of land at Erie Road, Bridge Street, Queen Street, and River Road. See Location Map below.

Pursuant to the subsection 47(4) of the Planning Act, and except for the purposes of section 24, the Minister deemed Ontario Regulation 592/22 to be and to always have been a by-law passed by the council of the City of Niagara Falls.
