This comment is about the Ministers proposed ability to issue orders. Orders are not something that people apply for. An order is something that is used to get somebody to follow the law. Call this what it is, an application to circumvente the rules.
Why is a section being added allowing the Minister the ability to issue an order to meet reduced standards? Currently, Section 26 in regulation 240 allows the director to file a closure plan with alternate closure measures that meet or exceed the standards.

Section 35 of the charter of rights and freedoms requires the crown to consult with aboriginal communities on activities taking place on the landscape. How will the crown determine if consultation with aboriginal communities is required if the notice for “minor alterations” is removed?

Given that the government is eliminating the need for technical reviews, what is the government planning on doing to ensure that the self certifications are legit? Checks and balances.
The government needs to slow down and consider Bill 71 more. First Nations are not supporting these rushed changes. The government needs to consult with First Nations and the public more, this needs to be more transparent and not so rushed.
