This notice is given by the applicant in accordance with section 47 of the Environmental Bill of Rights, 1993. The notice was prepared by the applicant and represents its position. It does not represent or reflect the views of the Government of Ontario, nor does the Government of Ontario make any representations about the accuracy of the content of this notice.

The applicant is seeking leave to appeal the decision of the Director, (Ministry of the Environment, Conservation and Parks, under section 20.2 of Part II.1 of the Environmental Protection Act., 1990, c. E. 19, as amended), in granting the Amended Environmental Compliance Approval (Air & Noise) Number 2778-D6UGB7 dated December 11, 2024, to Magna Powertrain Inc. operating as Unimotion-Gear, for the property municipally known as 245 Edward Street, Aurora, Ontario.

The applicant will seek an order from the Tribunal on the appeal either

  • revoking the Amended ECA or
  • varying the Amended ECA to require site-specific mitigation measures to address the noise and vibration impacts.

Grounds for leave to appeal

  • There is good reason to believe that no reasonable person, having regard to the relevant law and to any government policies developed to guide decisions of that kind, could have made the decision.
  • The decision in respect of which an appeal is sought could result in significant harm to the environment

An Environmental Compliance Approval (air & noise) with the Limited Operational Flexibility has been granted to Magna Powertrain Inc. operating as Unimotion-Gear, a manufacturing facility for drive plates/flexplates and reluctor wheels, located in the Town of Aurora, Ontario.

The emission sources from the manufacturing and associated processes that discharge to the air include:

  • welding;
  • cooling towers;
  • induction heat machines;
  • fume hood;
  • tanks;
  • washer;
  • cutting and machining

The amendment includes changes to the equipment inventory, general exhausts and increase to the production limit. Emissions to the air from this facility include:

  • manganese;
  • nitrogen oxides;
  • ethanolamie;
  • hexahydro-1,5-tris(2hydroxyethyl)-s-trazine;
  • particulate matter;
  • nickel and chromium VI

The Environmental Compliance Approval with Limited Operational Flexibility (air), when issued, permits modifications to the facility subject to limits on operational flexibility that include a production limit for the facility to be specified on the Environmental Compliance Approval with Limited Operational Flexibility (air). The limited operational flexibility conditions have an expiry date. The company will be required to make an application for amendment at that time to renew these conditions.

What is considered

The appeal body will consider the following two questions in deciding whether to grant you leave to appeal:

  1. is there is good reason to believe that no reasonable person, with respect to the relevant law and to any government policies developed to guide decisions of that kind, could have made the decision?
  2. could the decision you wish to appeal result in significant harm to the environment?
