On August 30, 2024, the Minister of Municipal Affairs and Housing filed a Minister's Zoning Order with the Registrar of Regulations as Ontario Regulation (O. Reg.) 337/24 in the City of Port Colborne. The Zoning Order was requested by the Minister of Economic Development, Job Creation and Trade.
Decision details
A Zoning Order, made pursuant to clause 47(1)(a) of the Planning Act, regulates the use of the land and the erection, location and use of any building or structure on the land. This Minister's Zoning Order was made based on a request from the Minister of Economic Development, Job Creation and Trade.
O. Reg. 337/24 facilitates development of a battery separator manufacturing facility. It applies to approximately 78.9 hectares of land east of the Welland Canal in the City of Port Colborne. See Location Map below.
Pursuant to subsection 47(4) of the Planning Act, and except for the purposes of section 24, the Minister deemed this zoning order to be a by-law passed by the council of the City of Port Colborne.
Effects of consultation
All comments received were taken into consideration prior to a decision being made.
The two submissions received were from members of the public regarding protection of the natural environment and access to information related to the project.

Why consultation isn't required
Part II of the Environmental Bill of Rights Act, 1993 does not apply to proposals to make a Minister’s Zoning Order (MZO) under subsection 47(1) of the Planning Act, or to amend or revoke an MZO under subsection 47(8) of the Planning Act.
Although not required, the ministry is providing public notice of this request for consultation.
Proposal details
A Minister’s Zoning Order, made pursuant to clause 47(1)(a) of the Planning Act, regulates the use of land and the erection, location and use of any building or structure on the land.
The Minister of Municipal Affairs and Housing is considering a request made by the Minister of Economic Development, Job Creation and Trade to make a Minister’s Zoning Order on the lands east of the Welland Canal, in the City of Port Colborne.
The site is approximately 78.9 hectares and are located along the northern municipal boundary line of the City of Port Colborne, south of Highway 58A, north of Forks Road East, and bounded by the Welland Canal to the west and Highway 140 to the east. The site is currently vacant and zoned for heavy industrial uses in the City of Port Colborne’s zoning by-law. See location map below.
The requested Zoning Order would permit:
- a battery separator manufacturing facility building that is approximately 2,000,000 square feet;
- parking lots;
- stormwater management ponds;
- private electric substations;
- private wastewater treatment plant; and
- tank yards
To help ensure decisions are made in a transparent manner and support government priorities, the Ministry is seeking feedback on whether this request should be considered and any additional information that may help inform a decision.
