Proposal summary

TSSA invites you to provide feedback on its publication of code adoption document (CAD) amendments for fuel oils. The Fuel Oil CAD is adopted by reference in Ontario Regulation 213/01. The CAD adopts a series of national safety codes into regulation.

Amendments to Fuel Oil Code Adoption Document (CAD) 2025

The Fuel Oil CAD is adopted by reference in Ontario Regulation 213/01 (O. Reg 213/01). The regulation applies to equipment where fuel oil is used as a fuel in the Province of Ontario. The CAD adopts a series of national safety codes into regulation.

National codes

TSSA proposes to adopt the latest edition (2024 editions) of CSA B139 series codes published by the Canadian Standards Association. The B139 series is arranged into four parts:

  • CSA B139.1.0 covers general requirements for large installations;
  • CSA B139.1.1 covers general requirements for stationary oil-burning engine installations;
  • CSA B139.1.2 covers general requirements for special oil-burning equipment installations, and;
  • CSA B139.2 covers general requirements for residential and small commercial building installations.

TSSA’s codes

In addition to the proposed Fuel Oil CAD amendments, TSSA is also in the process of updating the Field Approval Code (FAC) adopted by reference in the CAD. The FAC establishes the requirements for approval of appliances that are custom-made, built on site or produced in limited numbers.

  • Addition of an annual visual inspection requirement of fuel oil tanks, tubing, piping and fuel oil filters for leakage
  • New requirements to remove an aboveground or underground tank system that has not been used for more than three (3) years
  • New requirement added limiting the acceptance of tanks conforming to the American Petroleum Institute standard 650 for storage tanks (API 650) to field erected tanks with capacities that exceed 175,000 L
  • New requirements added for through-the-wall venting for condensing appliances

TSSA Field Approval Code

Current version

  • In-effect version of Field Approval Code applies
  • Currently adopts CSA B149.3-20, NFPA 85 and NFPA 86

In the draft 2025 version of CAD, TSSA has removed 10 out of 32 existing Ontario-specific amendments in the Fuel Oil CAD and added three new Ontario-specific amendments. In total, 25 Ontario-specific changes will continue to be enforced. Below is the change log.

Added (*Sections here refer to sections of the 2025 version of CAD)

  • Clause 1.1.5 – Adds and modifies B139 1.0 section 4.2.4 in relation to conversion of fuel sources by deleting sub-clause (a) to remove an inapplicable reference to authority having jurisdiction and renumbering subsequent sub-clauses.
  • Clause 1.1.13 – Adds and modifies B139 1.0 section 9.2.1 by deleting subsection (a) to remove an inapplicable reference to authority having jurisdiction and introducing a requirement that calculations be performed by a professional engineer.
  • Clause 1.1.15 – Adds and modifies B139 1.0 section 11.3.1 by removing an inapplicable reference to authority having jurisdiction and introducing a requirement that calculations be performed by a professional engineer.
