Seek leave to appeal

To seek leave to appeal, you need to do these three things:

You’ll need to prepare an application. You may wish to include the following things in your application:

What is considered

The appeal body will consider the following two questions in deciding whether to grant you leave to appeal:

  1. is there is good reason to believe that no reasonable person, with respect to the relevant law and to any government policies developed to guide decisions of that kind, could have made the decision?
  2. could the decision you wish to appeal result in significant harm to the environment?

Proposal details

This proposal pertains to an amendment of Environmental Compliance Approval No. 7627-9VRL8Z for a 2.06-hectare recycling and waste transfer facility. The site will be used for the sorting, processing, temporary storage, and transfer of solid, non-hazardous waste from residential, construction and demolition, and industrial, commercial, and institutional (IC&I) sources. Source-separated organics and putrescible waste will not be accepted.

Operations will include both manual and mechanical sorting, as well as loading, compacting, and baling. The facility will process an average of 500 tonnes of solid waste per day, with a maximum daily and storage capacity of 850 tonnes. All waste received will originate within Ontario, with the facility primarily servicing the County of Simcoe. Operating hours will be permitted 24 hours a day, seven days a week.

The proposed amendments, summarized below, are intended to enhance operational efficiency while maintaining full compliance with MECP regulations and applicable municipal by-laws.

  • Expanded Shipping and Receiving Hours: The proposed amendment would allow shipping and receiving of waste at the site from 5:00 a.m. to 7:00 p.m. Monday through Friday, and 7:00 a.m. to 5:00 p.m. on Saturdays, subject to applicable municipal by-laws. The current ECA permits shipping and receiving from 7:00 a.m. to 7:00 p.m. Monday through Friday, and from 7:00 a.m. to 5:00 p.m. on Saturdays.
  • Outdoor Waste Storage Revisions: The proposed changes would permit waste to be stored along the west side of the warehouse wall, whereas the current approval prohibits storage directly against the building’s exterior foundation walls.
  • Outdoor Storage of Wood Waste: The amendment also seeks approval for wood waste to be stored outdoors and clarifies that there are no doors on the main warehouse building.
