Decision details

Approval is granted to amend the existing Environmental Compliance Approval (waste disposal site) No. A-500-1188155825 for a processing facility in the City of Welland, Ontario. The approval permits the facility to increase the daily receiving rate from 100 tonnes per day to 200 cubic meters per day, the maximum storage of liquid soils increased from 100 tonnes to 2,250 cubic meters, and the storage of all other waste including dry processed soil and process derivative to 1,500 cubic meters (including temporarily stockpiled soil in the soil sorting area and dry processed soil pending testing).

The site is no longer approved to receive dry excess soil and only liquid soil generated within the Province of Ontario will be accepted at the site.

Water separated through gravity is infiltrated into the subsurface soils can be reused at the site or hydrovaccing operations, subject to meeting Table 3 of the Soil, Groundwater and Sediments Standards.

The groundwater monitoring program has been updated to include monitoring of 9 on-site groundwater wells instead of 5 wells, and the applicable regulatory compliance guideline is Guideline B-7 (Reasonable Use Guideline) instead of Table 3 of the Soil, Groundwater and Sediments Standards.

Effects of consultation

One response was received at Niagara District Office (NDO) in response to a Neighbor Notification which was forwarded to the Permission Branch for consideration. A summary of the comments and our response are noted below:

Comment: There are more than 1000 tonnes of processed soil.

Response: This is a compliance issue. It is our understanding that NDO conducted a site inspection on May 12, 2025.

Comment: Trucks are coming usually after 4pm to midnight.

Response: As per their current approval (Condition 19.2.), the site is approved to receive waste from 7:00am and 6:00pm, Monday through Friday. If the company is receiving waste outside the approved hours, the neighbor should contact the district office.

Comment: The site accepts waste in the absence of a trained person.

Response: As per Condition 24.1.1, Trained Personnel is required to supervise all shipments. This is deemed a compliance issue if the site is receiving waste without being inspected by a Trained Personnel. District Office is the point of contact for compliance related issues.

Comment: No check up if the incoming liquid soil is contaminated, and likely, their land is contaminated.

Response: Given the nature of liquid soil operations, it is not practically feasible to test each and every incoming hydrovac truck for chemical quality. However, the site is required to implement a groundwater monitoring to confirm that three is no leaching of contaminants into the groundwater. Also, the processed dry soil is required to be chemically analysed before sending off-site for reuse as per Soil Rules. The ministry’s technical support has reviewed the groundwater monitoring results and confirm the groundwater meets the ministry standards except at one location, and recommended modifications to the groundwater monitoring program. The current monitoring program is updated in light of the ministry’s hydrogeologist input.

This proposal is to amend Environmental Compliance Approval (waste disposal site) No. A-500-1188155825 for a processing facility in the City of Welland, Ontario. The waste processing facility has a total area of 2.9 hectares, and processes excess soil, including liquid soil. The amendment requested is for the facility to increase the daily receiving rate of the Site from 100 tonnes per day to 200 cubic meters per day. Additionally, the maximum storage of liquid soils to be increased from 100 tonnes to 2,250 cubic meters, and the storage of all other waste including dry processed soil and process derivatives to be 1,500 cubic meters (including temporarily stockpiled soil in the soil sorting area and dry processed soil pending testing).

The Site receives slurry from hydro vacuum vehicles from multiple sites in Ontario and dry soil is generated by physical water separation, decanting, and mechanical soil sorting equipment (roto screener). The dry processed soil is tested and reused on-Site for construction of berms or transported to an appropriate receiving Site for beneficial reuse depending on the soil quality and O. Reg. 406/19 requirements. If soil does not meet any of the excess soil quality standards (ESQS) outlined in O. Reg. 406/19 and the associated soil rules the material would be sent for disposal as solid non-hazardous waste to a licensed waste disposal site. Water separated through gravity is infiltrated into the subsurface soils at the Site and there is a groundwater monitoring program in place. Water that is decanted following gravity separation will also be pumped into the on-site cistern, which has a 50,000 litres capacity and will be reused in either hydro vacuum truck operations or dust control at the Site if the water is shown to meet the MECP O. Reg. 153/04 Table 2 Groundwater Standards. The Site is serviced by municipal water and is located in a non-potable groundwater area with industrial zoning.

Receiving and transporting soils take place between 7 am to 6 pm Monday to Friday, and processing on-site can be performed 24/7, unless otherwise restricted by municipal by-laws.
