Proposal details

Application has been made by 1712028 Ontario Inc. to amend the current site plan. The change would permit below water extraction in a portion of the 15m setback along the east boundary. This change would allow for the pond to connect with the adjacent proposed below water expansion application (application no. 626511). Application no. 626511 considered below water extraction within this setback as it anticipated the two sites would connect to form a single pond. A decision has not yet been made on application no. 626511. This proposal and the expansion application are being considered by the Ministry concurrently.

Public consultation opportunities

The adjacent expansion application (application no. 626511) by Port Colborne Quarries Inc. (1712028 Ontario Inc.) considered below water extraction of a portion of the eastern setback within Aggregate Reosurces Act licence no. 4444, to align with the proposed expansion site. The following agencies were circulated and provided with the opportunity to review and comment on that proposal: Ministry of Natural Resources, City of Port Colborne, Region of Niagara, Niagara Peninsula Conservation Authority, and the Ministry of Environment, Conservation and Parks. The consultation requirements under the ARA for an amendment to extract below the water table within setbacks were satisfied by the consultation undertaken for application no. 626511.

Other Information

The technical report requirements for an amendment to extract below the water table within setbacks are:

  • Water Assessment
  • Natural Environment Assessment
  • Planning and Land Use Considerations
  • Source Water Considerations

The above report requirements were satisfied by the technical reports prepared for application no. 626511. The following information was submitted to the Ministry of Natural Resources as part of the expansion application:

  • Summary Statement (‘Planning Justification Report’, which included Planning and Land Use Considerations)
  • Natural Environment Report (‘Natural Environment Level 1 and 2’)
  • Cultural Heritage Report (‘Archaeological Stage 1 and 2’ and ‘Cultural Heritage Screening Report’)
  • Water Report (‘Hydrogeological Level 1 and 2’)
  • Noise Assessment Report (‘Acoustical Impact Study’)
  • Blast Design Report (‘Blasting Impact Assessment’)
  • Site Plan

Details of these technical reports can be referenced in the ERO posting for the expansion application (019-3450).
