Six Nations requests that the Ontario Municipal Board (OMB) align the changes in the OMB policy as seen within the Provincial Policy Statement 2016, which states in section 4(3) “This Provincial Policy Statement shall be implemented in a manner that is consistent with the recognition and affirmation of existing Aboriginal and treaty rights in section 35 of the Constitution Act, 1982.” In this regard, Aboriginal and treaty rights should be recognized by the OMB when dealing with appeals.
