This is a horrible idea. We need to preserve our native species, and reducing their habitat to where they sleep not only allows for a lot more damage to their full habitat (as in, what they need to live) but removes protections for migratory birds. We don't need more legislation to gut environmental protection and go against Indigenous rights- those are more important than the interests of wealthy developers.
