The definition of habitat in the proposed act is inadequate as it totally neglects areas needed for animals to feed. Without adequate food for survival and reproduction (and the space to forage for it), preserving den sites etc. can quickly become irrelevant. Furthermore, by removing the prohibition on harassment of at-risk species, the proposed act opens an obvious loophole for developers to remove protected species from their target sites by harassment, even if a permit is not sought. The proposed act would be catastrophic even for species which remain listed as at-risk after the Premier's discretion has been applied.
