The removal of the requirement for a permit is completely unacceptable here, as enforcement after the fact is all but guaranteed to never take place. Even in the few cases where enforcement does happen, developers found to be at fault will plead ignorance and receive a slap on the wrist after potentially irreparable damage has been done to endangered species and their habitats.
Permits exist to prevent damage from happening in the first place; allowing developers to do whatever they wish and then hoping to catch and punish them retroactively is completely unrealistic.
