Following the proposed changes, Cabinet would be allowed to exempt proponents and projects from requirements under ANY provincial law or regulation, including bylaws of municipalities and local boards, that would otherwise apply in that zone.
I don’t trust Cabinet sufficiently to allow laws to simply be overridden. This is too much power.
The legislation also contains provisions to block court actions that would arise from this power. Again, too much power without oversight, the resort of the courts is vital to democracy. The government should never be able to exempt its actions from being legally contested.
