The Ministry of Infrastructure will proceed with amending the Rebuilding Ontario Place Act, 2023, to provide an exemption from Part II of the Environmental Bill of Rights, 1993 for proposals for provincial permits and approvals related to the Ontario Place Redevelopment Project.

Decision details

Through the proposed Protect Ontario by Unleashing our Economy Act, 2025, the Ministry of Infrastructure has decided to amend the Rebuilding Ontario Place Act, 2023. The amendment provides that Part II of the Environmental Bill of Rights, 1993 does not apply to proposals for instruments for or related to the Ontario Place Redevelopment Project or enterprises or activities that further the Ontario Place Redevelopment Project (i.e., not at the site).  Under Part II of the Environmental Bill of Rights, 1993 proposals for environmentally significant instruments would otherwise be subject to public notice and public participation requirements. In addition, amendments to the Rebuilding Ontario Place Act, 2023 are proposed to provide regulation making authority under that Act related to the exemption.

Effects of consultation

A total of 3,944 comments have been received on the Environment Registry posting.

The majority of the comments received were determined to be outside the scope of this proposal to amend the Rebuilding Ontario Place Act, 2023, as they were regarding other proposals under Bill 5, broader environmental protection concerns, or concerns related to other aspects of the Ontario Place redevelopment project. We would like to note that comments not related to this amendment or the Ontario Place redevelopment project have been appropriately redirected to the relevant Ministries for their consideration.

Several comments received  raised concerns about a perceived lack of Indigenous consultation. To clarify, this amendment does not impact the Province’s duty to consult with Indigenous communities, which is a Constitutional obligation. The Ministry of Infrastructure has, and will  continue to consult with  identified First Nations  throughout the duration of the Ontario Place redevelopment project.

All comments received were given full consideration by the Ministry of Infrastructure.

The proposed legislation provides an exemption from Part II of the Environmental Bill of Rights, 1993, which includes requirements for giving public notice and opportunities for comment, for proposals for provincial permits and approvals related to the Ontario Place redevelopment project, or that further the project (i.e., not at the site). Proposals for these permits and approvals would otherwise be required to be posted to the Environmental Registry of Ontario.

In addition, amendments to the Rebuilding Ontario Place Act, 2023 are proposed to provide regulation making authority under that Act related to the exemption.
