Halton Conservation Authorities are now regulating up to 120m (380 ft) of private property from wetland areas;
Whereas various court cases have demonstrated that Conservation Authorities have failed to maintain accurate maps regarding wetland areas thereby regulating well over the 120m allowed in their regulations;
Whereas these regulations directly affect the property value of businesses and land owners;
Whereas these regulations effectively prohibit the development and enjoyment of private property which the courts have now declared to be ‘functional expropriation’ of private property;
Restrict Conservation Authorities to a maximum 15m (49 ft) from any wetland and if greater than 15m then the Conservation Authorities shall financially compensate private property owners based on fair market value.
Therefore, restrict Conservation Authorities to enforcement of their regulation only in cases where the Authorities can establish their maps are accurate within 2m.
