I believe that a Review Board that is not independent of the Authority that they are to govern, defeats the purpose of such a Board.
It is being proposed that the duty of conservation authority board members is to act in the best interest of the conservation authority.
I disagree. I believe that a Review Board needs to be independent from the Authority it governs, in justifying policy.
If not, it is simply a steeping stone in a court challenge. The correct board would have a place for a represent of private property owners to be amongst its members.
In a conversation with the Lands and Mining Tribune, it was acknowledged that less than 1 percent of rulings are overturned and that one is simply better off skipping these boards and going straight to court.
It was also citied in the Judge's Ruling of the Gilmore et al. v. Nottawasaga Conservation Authority that the Review Board is simply an extension of the Conservation Authority.
The path to these Review Boards should be simply and the Board independent of all.
