We need to structure a formal governance model to deal with how excess fill is shifted from the Federal/Provincial/Municipal governments.

The Municipality is powerless, well they feel they are as the MOECC and Feds will not assist them in shutting down large scale fill operations at aerodromes as larger fill operators threaten litigation. Having clear policies is fine, but not enabling the government agencies to enforce them with legal action when for profit fill operators use bullying tactics to frighten municipalities.

For 5 years I have lived across a large scale fill operation on the Oak Ridges Moraine. The Municipalities are to protect the ORM, yet they cower as the Fill Operator threatens to sue, the Town's legal council is way over their head and there is lack of prescriptive and defined polices on this topic.

For environmentally sensitive areas, large scale filling must be Prohibited. If you must fill, you can only use Table 1 or better soils which is of the same composition of the soil that the Moraine needs to do its job. Fill Operators are for profit, they will use the system and lack of policies to make profit at the cost of the environment.

We can't leave a legacy like the Love Canal for our children and their children to clean up.
