My last comment was a general comment on Bill 132, and i apologize that i did not address the Polluters Penalties area specifically, however, i hope my first comment still stands.
This area is complicated and from what i understand the gov't is not totally clear on their proposals. The new proposals as written so far, although it expands the use of administrative monetary penalties (AMP's), there are several areas that have yet be set out in regulations. From what i've read so far, the appeals process could be complicated, tie up red tape (which this gov't apparently has been trying to eliminate), and all of this is a major concern. My colleagues in the environmental movement have also informed me that appeals made to AMP's would become easier. These are alarming signs.
Also, by placing a cap on penalties rather than paying per day until a possible spill is cleaned up, is a disincentive to polluters to take action to clean their mess. The proposed penalties will not match the possible harm done to the environment.
