• “garage” should be added to O.Reg. 153/04, Schedule D Phase one environmental site assessments, Table 2 Potentially Contaminating Activities. This would allow QP’s to flag this land use as a PCA that leads to an APEC.
• B(2) – “The qualified person has confirmed and documented evidence from the Phase one ESA that the site does not have any areas of potential environmental concern (APECs) resulting from off-site potentially contaminating activities (PCAs)”. This is should work as long as it is acknowledged by the MECP reviewers that the QP will have be able to determine that a off-site PCA does not result in a APEC on the property as long as the groundwater in the overburden is blocked from migrating onto the property in some form (i.e. cut off wall of some nature). The majority of urban sites currently have off-site PCAs that could result an APEC. If the QP cannot make this argument in the Phase One ESA for off-site PCA’s not causing APECs because the groundwater in the overburden is blocked at the property, then this exemption will not be practical to be used for urban redevelopment.
