Please find below comments, on the proposed amendments to the O.Reg. 406/19, from the City of Vaughan's Infrastructure Delivery regarding infrastructure projects in low-risk areas and from Development Engineering regarding stockpile sizes.

1) Exempt construction work completed on public rights-of-way in low-risk project areas such as residential, parkland and/or institutional to build upon the amendment above and make it less ambiguous for City work.

2) The increase from 2500 m3 to 10000 m3 presents a significant increase in volume that will likely lead to an increase in nuisance and adverse effects to adjacent landowners (e.g., noise, dust, odours, road damage, unsightly stockpiles, etc.). We recognize there is likely some merit for the industry in increasing the stockpile sizes for a property but we suggest that the MECP still strongly consider a cap on the maximize size of a particular stockpile so that some of these nuisance and adverse effects (along with heights) can be mitigated or more appropriately managed. (e.g. maximum stockpile size is 2500 m3, so a site can’t have more than 4 stockpiles). In this way, chemical characterization of stockpiles would be easier as well and likely to be more accurate.
