We are counsel to the following owners of 99 Ryding Avenue in the City of Toronto: Irving Ungerman Limited, Karl Ungerman Limited, Shar Tem Holdings Limited, St. Clair Poultry Packers Co. Limited and Stork Wasser Realty Limited (collectively, “Ungerman”).
We are also counsel to 810277 Ontario Inc. and Paletta International Corporation (collectively, “Paletta”), the owner of 109 Ryding Avenue in the City of Toronto.
99 Ryding Avenue and 109 Ryding Avenue are adjacent properties south of St. Clair Avenue West and west of Keele Street. Both properties are currently designated Core Employment Areas on Map 17 – Land Use Plan and identified as Employment Areas on Map 2 – Urban Structure of the City of Toronto Official Plan. The properties do not form part of a Provincially Significant Employment Zone.
Both properties are currently occupied by the Maple Leaf Foods facility, which will be ceasing operations in less than one year, at which point the properties will be vacant. Many of the properties surrounding 99 Ryding Avenue and 109 Ryding Avenue have already been converted from employment area designations to mixed use designations, as the Keele-St. Clair area continues to evolve from its industrial past to a mixed-use complete community served by higher-order transit.
We are aware that Michael Foderick of McCarthy Tetrault LLP recently made a submission to the Minister of Municipal Affairs and Housing in respect of City of Toronto Official Plan Amendment No. 591 (“OPA 591”) through ERO No. 019-5868. That submission was made on behalf of a number of landowners on Ryding Avenue and Ethel Avenue, including Ungerman and Paletta, and requested that the Minister modify OPA 591 by redesignating various lands on Ryding Avenue and Ethel Avenue to Mixed Use Areas.
On behalf of Ungerman and Paletta, we are writing to confirm our support for Mr. Foderick’s submission and, in particular, our full support for the redesignation of 99 Ryding Avenue and 109 Ryding Avenue (and surrounding lands on Ryding Avenue and Ethel Avenue) to Mixed Use Areas on Map 17, and the removal of these lands from the Employment Areas on Map 2, by way of modifications to OPA 591.
