f The approved stormwater management works consist of the following:
Watershed Area 1: one stormwater management system serving 2.1 hectares of west parking area located at 265 Talbot Street West, consisting of stormwater collection and conveyance system, surface ponding storage area and an oil/grit separator, discharging into an enclosed storm sewer named Sun Parlour Drain
Watershed Area 2: one stormwater management system serving 26.1 hectare of drainage area including greenhouses, service buildings, parking/loading and other areas located at 265 Talbot Street West, consisting of roof water drainage pipe systems, swales and on-site storm sewers, an oil/grit separator, one stormwater management pond located at 338 Mersea Road 3 and having a permanent storage volume of 9,067 cubic metres and a maximum active storage volume of 17,266 cubic metres, discharging with a controlled maximum release rate of 44 litres per second for the 100 year storm event to the E.F. Ives Drain via a 250 millimetres diameter outlet pipeline located at neighbouring property - 310 Mersea Road 3.

If you’re an Ontario resident, you can start the process to appeal this instrument decision.
First, you’ll need to seek leave (i.e. get permission) from the relevant appellate body to appeal the decision.
If the appellate body grants leave, the appeal itself will follow.
Seek leave to appeal
To seek leave to appeal, you need to do these three things:
- prepare your application
- provide notice to the minister
- mail your application to three parties
1. Prepare your application
You’ll need to prepare an application. You may wish to include the following things in your application:
- A document that includes:
- your name, phone number, fax number (if any), and/or email address
- the ERO number and ministry reference number (located on this page)
- a statement about whether you are a resident in Ontario
- your interest in the decision, and any facts you want taken into account in deciding whether you have an interest in the decision
- the parts of the instrument that you’re challenging
- whether the decision could result in significant harm to the environment
- the reason(s) why you believe that no reasonable person – having regard to the relevant law and to any government policies developed to guide decisions of that kind – could have made the decision
- the grounds (facts) you’ll be using to appeal
- the outcome you’d like to see
- A copy of the instrument (approval, permit, order) that you you are seeking leave to appeal. You’ll find this in the decision notice on the Environmental Registry
- Copies of all supporting documents, facts and evidence that you’ll be using to appeal
What is considered
The appeal body will consider the following two questions in deciding whether to grant you leave to appeal:
- is there is good reason to believe that no reasonable person, with respect to the relevant law and to any government policies developed to guide decisions of that kind, could have made the decision?
- could the decision you wish to appeal result in significant harm to the environment?
2. Provide your notice
You’ll need to provide notice to the Minister of the Environment, Conservation and Parks that you’re seeking leave to appeal.
In your notice, please include a brief description of the:
- decision that you wish to appeal
- grounds for granting leave to appeal

3. Mail your application

This proposal from Aphria Inc. is for an amendment to Environmental Compliance Approval number 4700-9NLHEU for the stormwater management works including alterations to existing stormwater management facilities including enlarging an existing S.W.M. infiltration pond to accommodate additional greenhouse facilities and a new separate S.W.M system for the west parking lot area for collection, transmission, treatment and disposal of stormwater run-off from the lands located at 265 Talbot Street West and 338 Mersea Road 3, in the Municipality of Leamington, County of Essex, Ontario.
The stormwater management works consists of the following:
- roof water drainage pipe systems, swales and on-site storm sewers discharging roof top runoff to the stormwater detention pond;
- one stormwater management detention/wet pond having an active storage volume of 17,266 cubic metres with a maximum active water depth of 1.45 metres for the 1:100 year storm event, discharging a maximum release rate of 44 litres per second into the E.F. Ives Drain;
- one outlet structure containing a 250 millimetres diametres outlet pipe and containment valve;
- one emergency overflow spillway and containment berm directing flows in excess of the 1:100 year storm to the E.F. Ives Drain;
- one oil grit separator (OGS) model 3612WQA serving the parking and truck maneuvering areas (0.65 hectares);
- on-site storm sewers, discharging surface runoff from the parking lot into the enclosed Sun Parlor Drain;
- one outlet structure (CBMH29) containing a concrete block weir to direct flows from the parking lot to the OGS unit;
- one OGS model 3620WQA serving the west parking lot (1.918 hectares); and
- one existing outlet structure (EXCBMH) containing an outlet pipe fitted with a 240 millimetres diametres by 600 millimetres long orifice, and containment valve
