The Town of South Bruce Peninsula has withdrawn its application under section 17 of the Endangered Species Act, 2007 for a permit to authorize beach maintenance activities at Sauble Beach that would have impacted Piping Plover and its habitat.

Pourquoi une consultation n’est pas nécessaire

The ministry is not required to consult on this proposal for an instrument since it relates to an animal (Piping Plover) and therefore does not meet the criteria set out in subsection 1.3 (6) of Ontario Regulation 681/94 of the Environmental Bill of Rights, 1993.

Although consultation was not required, the ministry did consult with the public on this proposal by posting ERO# 019-1818 for public comment from May 25, 2020 to June 25, 2020. To ensure transparency, the ministry is providing details of its decision and the effects of consultation on decision-making in this notice.

Instrument decision

The Town of South Bruce Peninsula (the proponent) applied for an overall benefit permit under clause 17(2)(c) of the Endangered Species Act, 2007. The proposal was to conduct beach maintenance activities at Sauble Beach that impact Piping Plover and its habitat.

The proponent was also seeking a health or safety permit under clause 17(2)(a) of the act to:

  • conduct mechanical raking to remove hazards to beach users in late spring before Piping Plovers arrive at the beach each year (typically in March or early April)
  • undertake emergency-related activities that may be required to remedy health or safety hazards during the active season

On April 7, 2021, the proponent withdrew both its overall benefit and health or safety permit applications. No permit was issued to the proponent.
