Amendment No.1 to the official plan for the Sudbury East Planning Area is a site-specific amendment that applies to lands at 37 St. Antoine Street, Noelville, ON. The subject property is legally described as Concession Number 3, Lot 12, Reference Plan Number 53R-6253, Parcel Number 42866, Township of Martland, in the Municipality of French River, in the District of Sudbury. The site is a corner lot fronting onto St. Antoine Street and Champlain Street, with a total area of approximately 0.23 hectares. The site houses an existing one-storey building with a ground floor area of approximately 446 M2.

The purpose of OPA No.1 is a site-specific amendment to change the official plan designation of the subject property at 37 St. Antoine Street, Noëlville in the municipality of French River, from “Institutional” to “Village Residential”. This change in land use designation is to facilitate the adaptive reuse of an existing one-storey building for an existing dental office and four new dwelling units. A subsequent zoning by-law amendment will be required to rezone the subject lands from “Institutional” to “Commercial Community”, thereby allowing for the adaptive reuse of the subject property as described above.

Official Plan Amendment No.1 was reviewed for consistency with the 2020 Provincial Policy Statement (PPS) and matters of provincial interest, as expressed in the Planning Act. Official Plan Amendment No.1 is consistent with the PPS and the Growth Plan for Northern Ontario and will not negatively impact the environment.

The last date to appeal this decision is May 12, 2022.

Appeal process for decisions published before June 1, 2021

You can appeal all or part of this this instrument to the appeal to the Local Planning Appeal Tribunal (LPAT) by submitting a notice of appeal to the Minister of Municipal Affairs and Housing.

There is an additional “leave to appeal” right under the Environmental Bill of Rights.

Who can appeal

A notice of appeal can be submitted by:

  • individuals
  • corporations
  • public bodies

A notice of appeal can’t be submitted by:

  • an unincorporated association
  • an unincorporated group

You can, however, submit a notice of appeal as a member of the unincorporated association or group.

You have to have made an oral submission at a public meeting or a written submission to the council before the official plan amendment was adopted. Note: this is not required if you are appealing a proposal for provisional consent (no official plan in place).

Notice of appeal

Your notice of appeal must include:

  • the specific part, or parts of the official plan amendment that you wish to appeal
  • the reasons for your appeal
  • the appeal fee, payable by certified cheque or money order to the Minister of Finance, Province of Ontario

On December 2, 2021, the Sudbury East Planning Board voted to recommend a site-specific OPA for the Municipality French River. The Municipality of French River, by By-law 2021-75, adopted the proposed OPA on December 7, 2021 and has forwarded the OPA to the Ministry of Municipal Affairs and Housing for a decision under section 17 of the Planning Act.

The proposed OPA will change the designation of lands from Institutional to Village Residential to facilitate the adaptive reuse of an existing one-storey building for a medical office and four dwelling units of varying sizes. The current Institutional designation allows for the building to be used as a medical office but does not support residential use.

The proposed amendment will be reviewed for consistency with the Provincial Policy Statement and matters of provincial interest, as expressed in the Planning Act. This includes land use compatibility, water and sewage servicing, affordable housing, and the provision of existing as well as planned infrastructure and utilities.
