The Environmental Compliance Approval (ECA) permits a 4.27-hectare anaerobic digestion facility, approved to process 225,000 tonnes of organic waste feedstock per year to generate a total power of 2,850 kilowatts of electricity, 3,020 kilowatts of thermal power and 3,600 Nm3 /hour of biogas to renewable natural gas.
The ECAissued is multimedia and contains terms and conditions with respect to the following:
- waste management and processing
- air emissions
- noise emissions
- industrial sewage
The terms and conditions of the Environmental Compliance Approval related to the management and disposal of waste and the generated digestate will ensure that waste is managed and the site is operated in a manner which is protective of the health and safety of the environment and public.
The terms and conditions in the ECA related to waste management, processing and disposal detail the following:
- the site's approved complaint response procedure
- conditions for a public liaison committee
- record keeping and reporting requirements
- daily inspection and housekeeping requirements
- maximum waste processing and storage capacities
- feedstock and digestate sampling, monitoring and quality control
- financial assurance
- staff training
- responsible site closure
- best management practices be employed in the operation of the site

If you’re an Ontario resident, you can start the process to appeal this instrument decision.
First, you’ll need to seek leave (i.e. get permission) from the relevant appellate body to appeal the decision.
If the appellate body grants leave, the appeal itself will follow.
Seek leave to appeal
To seek leave to appeal, you need to do these three things:
- prepare your application
- provide notice to the minister
- mail your application to three parties
1. Prepare your application
You’ll need to prepare an application. You may wish to include the following things in your application:
- A document that includes:
- your name, phone number, fax number (if any), and/or email address
- the ERO number and ministry reference number (located on this page)
- a statement about whether you are a resident in Ontario
- your interest in the decision, and any facts you want taken into account in deciding whether you have an interest in the decision
- the parts of the instrument that you’re challenging
- whether the decision could result in significant harm to the environment
- the reason(s) why you believe that no reasonable person – having regard to the relevant law and to any government policies developed to guide decisions of that kind – could have made the decision
- the grounds (facts) you’ll be using to appeal
- the outcome you’d like to see
- A copy of the instrument (approval, permit, order) that you you are seeking leave to appeal. You’ll find this in the decision notice on the Environmental Registry
- Copies of all supporting documents, facts and evidence that you’ll be using to appeal
What is considered
The appeal body will consider the following two questions in deciding whether to grant you leave to appeal:
- is there is good reason to believe that no reasonable person, with respect to the relevant law and to any government policies developed to guide decisions of that kind, could have made the decision?
- could the decision you wish to appeal result in significant harm to the environment?
2. Provide your notice
You’ll need to provide notice to the Minister of the Environment, Conservation and Parks that you’re seeking leave to appeal.
In your notice, please include a brief description of the:
- decision that you wish to appeal
- grounds for granting leave to appeal

3. Mail your application

This proposal is for an amendment to Environmental Compliance Approval No. 1442-7RRKQL. The proposed amendments will allow for the expansion of the current operations to allow for processing to be more efficient. The following changes to the approval are proposed:
- expansion of the receiving hall
- expansion of existing pumphouses to contain infrastructure such as pumps and allow for chillers to be added to the anaerobic digestion process
- addition of a new receiving tank, thermophilic acidification reactor, and anaerobic digester with gas dome
- increase in the height of an existing receiving tank
- addition of a second renewable natural gas system, with flare, stack and Volatile Organic Compound removal system
- addition of batteries for energy storage on site
- addition of a natural gas boiler to support heat requirements in the anaerobic digestion process
- site changes to allow for containment of stormwater, earthen berm and ring road due to building expansions
- addition of a fertilizer load out area
The tonnage of organics permitted to be received at the facility will increase from 195,000 tonnes to 225,000 tonnes per year.
There will be no changes to the approved operating hours at the facility (24 hours per day, 7 days per week).
