Re: Schedule 2, Bill 238, Emergency Management Modernization Act, 2024

We are writing to provide staff feedback from the Regional Municipality of York regarding Bill 238, Emergency Management Modernization Act, 2024 as posted for public input on December 9, 2024.

York Region recognizes the emergency management landscape is increasingly complex and supports efforts to ensure Ontario is safe and prepared.

With respect to Schedule 2, which amends the Ministry of Community and Social Services Act, York Region recommends:

- Clarification be provided regarding the terms “entities prescribed by the regulations” and “extraordinary measures” so impacted organizations and program areas are clearly identified
- Additional information be provided on how directives may impact regional flexibility and autonomy in responding to emergencies based on local needs, including unique needs of diverse communities
- Consideration be given to how directives may increase funding and resource pressures on local agencies, if diversion of existing resources is required
- Consideration be given to how directives may impact operational coordination between regional and local municipal governments
- A requirement to consult municipalities and the impacted entities before issuing directives
