Bill 238, Emergency Management Modernization Act, 2024, was introduced in the Ontario Legislature on December 9, 2024 and this proposal notice was published to the Environmental Registry for a 45-day consultation period. Bill 238 did not pass before the Legislature dissolved on January 28, 2025. The Bill was reintroduced on May 26, 2025, as Bill 25, Emergency Management Modernization Act, 2025, in substantially the same form as Bill 238, with minor updates. The decision notice has been updated to reflect the change in bill title.

Decision summary

​​The government amended the Emergency Management and Civil Protection Act (EMCPA) to strengthen provincial leadership and coordination in emergency management, enhance community capacity, and formally outline Ontario Corps as a key function in supporting emergency preparedness and response efforts across the province. 

Decision details

​​Bill 25, Emergency Management Modernization Act, 2025 includes the same proposed amendments to the EMCPA as the previous Bill 238 with only minor technical and consequential revisions including: 

  • ​Updated the definition of “Minister” under EMCPA to reflect the creation of the Ministry of Emergency Preparedness and Response (MEPR) on March 19, 2025, ensuring the Minister has appropriate authority.
  • ​Changed the bill’s short title to the Emergency Management Modernization Act, 2025 to reflect its reintroduction year.
  • ​Commencement provisions were updated to refer to provisions coming into force on order of the Lieutenant Governor in Council instead of proclamation of the Lieutenant Governor, to align with recent amendments to the Legislation Act, 2006.  

​Bill 25 received Royal Assent on December 3, 2025. 

​Schedule 1 of the Emergency Management Modernization Act, 2025 comprehensively amends the EMCPA to enable a more effective, coordinated, and comprehensive approach to emergency management by strengthening provincial leadership and coordination, while laying the foundation for deeper collaboration with communities and emergency management partners through enhancing community capacities across the province.  

​The amendments build on actions to date and the valuable feedback received during engagements and aim to enhance emergency management in the province by: 

  • ​Ensuring a unified understanding of emergency management across Ontario.
  • ​Facilitating the coordination of provincial emergency management activities through the Ministry of Emergency Preparedness and Response as the one window for emergency management coordination, under the leadership of the Minister and direction of the Commissioner of Emergency Management.
  • ​Establishing Ontario Corps – which includes personnel, services, equipment, materials and facilities that the province can coordinate for deployment and use to help communities – as a key provincial emergency management function.
  • ​Enhancing clarity and accountability in provincial emergency management programs. 

​In addition, the amendments will support enhanced community emergency management capacity subject to future regulations by: 

  • ​Supporting municipalities by enabling flexibility for municipal emergency management programs based on needs and capacity.
  • ​Enhancing clarity and accountability in emergency management by clarifying processes for municipal declarations of emergency and requests for assistance.
  • ​Recognizing and strengthening coordination with emergency management partners.  

Enhancing Ontario’s emergency management capacity is part of the government’s plan to build a stronger and more resilient province with the necessary tools in place to ensure the safety and wellbeing of people across the province.

Effects of consultation

​​A total of 16 unique comments were submitted on the Environmental Registry of Ontario during the comment period between December 9, 2024 to January 23, 2025. One duplicate comment was submitted.  

​Feedback related to Schedule 1 was generally supportive. Key themes included: 

  • ​Provincial Coordination: Some comments recommended further clarification of roles and responsibilities across MEPR, ministries, municipalities, non-governmental organizations, Indigenous organizations, and other partners. Suggestions included broadening oversight structures and integrating Indigenous knowledge and leadership into the legislation. Some comments also related to clearer parameters for Ontario Corps deployment and protections for volunteers, including funding, liability, and insurance.
  • ​Municipal responsibilities: Some comments related to the changes to the municipal emergency declaration process, including to provide input on how the new requirements will be operationalized alongside some recommendations to strengthen the new preconditions (i.e., requiring consultation with emergency management plans). Other comments provided feedback on the proposed joint emergency management program and planning provisions to be introduced and included requests for guidance on managing multi-jurisdictional emergencies when this requirement is implemented and considerations to inform regulation development.
  • ​Regulation development: Some comments related to the importance of engaging municipalities, Indigenous organizations, and other stakeholders in regulation development and recommended specific community partners that should be involved in regulation development. Some comments also recommended considerations related to future program requirements set out under regulation such as to include considerations for animals and vulnerable populations in emergency planning, and to include clear parameters for regulatory compliance. 

​Comments on the bill were carefully reviewed and considered, and did not result in amendments to the Act as feedback raised was assessed to be better addressed through the development of future regulations under the Act and supporting programs, plans and guidance.  

​Ontario is committed to continued collaboration with emergency management partners throughout the implementation of amendments to the EMCPA and the development of supporting regulations and guidance. Feedback received on this bill and through future engagements with partners, will inform implementation next steps. 

​Of the 20 submissions, six submissions included feedback on Schedule 2 of the Bill which amends the Ministry of Community and Social Services Act (MCSSA) to improve the government’s ability to provide more uniform, timely and responsive direction in extraordinary situations to service providers that are funded by MCCSS. This feedback indicated areas for further clarification and raised some concerns about additional strain on the social services sector.  

​Feedback relating to Schedule 2 of the Bill was considered by MCCSS but did not result in amendments to the Bill as MCCSS intends to develop regulations that would further define the service providers as well as the extraordinary situations to be covered under the new proposed authority. Extraordinary situations may include for example, natural disasters or interruptions to essential services. MCCSS will further consider the feedback received during development of draft regulations. Stakeholders will also have an opportunity to provide additional feedback when the proposed draft regulations under the MCSSA are posted to the Ontario Regulatory Registry. For clarity, there are no immediate impacts of the proposed amendments to the MCSSA on service providers.

Emergency Management and Civil Protection Act Amendments

With the increasingly complex emergency management landscape caused by risks like extreme weather events, wildland fires and cyber-attacks, it is more important than ever to ensure that Ontario is safe, practiced and prepared. The government is introducing legislation to modernize the Emergency Management and Civil Protection Act (EMCPA) that, if passed, would strengthen provincial emergency management coordination and leadership and support enhanced community emergency management capacity.

Emergency Management Ontario (EMO) engaged with more than 480 partners and stakeholders over Summer 2024 through 14 in-person and 31 virtual engagements and received 90 written submissions on a publicly posted discussion guide.

The proposed amendments would strengthen provincial leadership and coordination of emergency management by:

  • Ensuring a unified understanding of emergency management across Ontario.
  • Facilitating the coordination of provincial emergency management activities through Emergency Management Ontario as the one window for emergency management coordination, under the leadership of the Minister and direction of the Commissioner of Emergency Management.
  • Identifying Ontario Corps – which includes personnel, services, equipment, materials and facilities that the province can coordinate for deployment and use to help communities – as a key provincial emergency management function.
  • Enhancing clarity and accountability in provincial emergency management programs.

In addition, the proposed amendments would support enhanced community emergency management capacity by:

  • Supporting municipalities by enabling flexibility for municipal emergency management programs based on needs and capacity.
  • Enhancing clarity and accountability in emergency management by clarifying processes for municipal declarations of emergency and requests for assistance.
  • Recognizing and strengthening coordination with emergency management partners. 

The proposed amendments to the EMCPA will be posted online for public feedback and will be available for 45 days, until January 23, 2025.

 

Regulatory Impact Analysis

If passed, a phased approach to implement the proposed amendments is planned to support the transition to new requirements and engage partners on the development of supporting regulations.

There are small, anticipated impacts to regulated entities, specifically municipalities, associated with implementation of the proposed legislative amendments, if passed, in the areas of: learning about the proposed amendments; potentially responding to requests for information regarding their emergency management program or plan; and reporting during and following a municipal declaration of emergency.

The impact from future potential regulation changes may be offset through burden reduction opportunities for municipalities to collaborate on emergency management program requirements, potential increased flexibility in meeting annual requirements subject to criteria, and cost avoidance measures.

If the Emergency Management Modernization Act, 2024 is passed, EMO proposes to engage partners on the development of supporting regulations. Where additional requirements for regulated entities are being considered, further engagements will help assess the regulatory impact and the support needed to meet any new requirements.
