The proposed replacement for the existing act is far too lax. It removes vital protections in the permit-based regulations which preclude damaging actions to registration only and permission to begin operations which essentially nullifies the protection, relying on the registrants to act against their own self-interest in registering. While attempting to remove duplicative Federal protections, the newly proposed act cuts too many avenues for community actors to present their case for protections. Laws which prohibit community members from having a voice in their own communities by definition provides benefits for commercial enterprise. The replacement act is thinly veiled pro-development in the guise of ‘improved’ protection. I am firmly against such blatant commercial favoritism.
