I understand that reduction of duplication with federal laws provides a more streamlined approach, and that economic considerations are necessary for growth, especially for housing.
However, I am concerned that "The government would also have discretion to remove protected species from the list." I fear that would give the government unchecked ability to collude with developers to circumvent the law.
In addition, the reduction of the size of a habitat to include basically the space of the nest or the extent of roots does not allow for the safety of the animal or plant should development happen directly beside its living space. It increases the risk of forcing animals to move out of their habitats.
Finally, registration first allows developers to kick animals out of hide evidence to promote development--without the oversight of a third party this gives too much power to developers.
