The proposed Minister’s Zoning Orders (MZOs) for Midtown Oakville clearly do not satisfy the Ontario government’s own stated criteria for their use. The project lacks municipal support: Town Council has not endorsed it, and well-documented community opposition is evident. There is no valid basis for overriding established provincial, regional, or municipal planning frameworks, including OPA 70. Nor is there any genuine urgency, as the proponent’s own schedule indicates that construction would not meaningfully begin until after 2030, with full build-out extending for another two decades.

MZOs are intended to be rare, exceptional instruments—not a self-serving alternative to proper planning. In this case, the sole justification advanced is “zoning certainty,” which in practice functions to entrench speculative land value, transfer risk from the developer to the public, and lock in an outdated proposal. Doing so would undermine the Town’s ability to respond over time to actual housing needs, infrastructure constraints, and evolving conditions.
