City of Toronto staff have reviewed and are generally supportive of the proposal for a new regulation to set out requirements and standards for Secondary Units under S.35.1(2)(b) of the Planning Act.
However, the City would like to advise of some implementation challenges associated with the proposed approach of allowing secondary suites without regard to the date of construction of the primary building.
Currently, the City's Zoning By-law 569-2013 permits Secondary Suites in a Detached House and includes a condition that the entire building must have been constructed more than 5 years prior to the introduction of a secondary suite. This 5-year rule is intended to provide a distinction between a secondary unit in a Detached House and a Duplex. Based on the City's Zoning By-law, the regulation as written could permit the construction of duplexes rather than single detached houses with a secondary suite. The City will need to revisit the Zoning By-law definitions for building types in order to address this implementation issue.
