CN's position that they're concerned about future complaints about noise, and odour is ridiculous. If that were the case then they should have appealed the process of allowing people already living in the area, and areas even closer to their yard. They should have appealed development of the Hess St. temporary shelters. The area they convern themselves with is already well developed, and home to thousands. How can rebuilding the blight that is the Jamesville development be of any consequence to CN? They are merely stalling this project on the presumption that in our litigious society there will be suits in the future - ridiculous and unfounded. The redevelopment of Jamesville needs to move forward now. CN has no place trying to invoke their will on those that choose to live nearby their operations. As an example, I currently reside on a dead end street with the CPKC rail running at the end. Yes, the trains pass by regularly, including in the night. Yes there is noise, but there is no odour. The choice to move here was conscious, and it does not affect our anticipated quality of life. If someone chooses to reside near a rail yard, near an airport, or close to an industrial sector, then that person alone is responsible for their choice.
