In response to the proposed Minister’s Zoning Order (MZO) for 405 James Street North in Hamilton (ERO number 025-0807):
While I support building more housing, I am concerned that the current proposal leaves affordable housing optional, dependent on funding rather than enforceable commitments.
The proposal mentions 46–210 affordable units “depending on funding obtained.” This is too vague and places affordability at risk. As such, I urge the Minister to use the enhanced powers granted under subsections 47(4.1) to 47(4.16) of the Planning Act to:
(1) Guarantee a minimum number of affordable units within the development—regardless of whether external funding is secured.
(2) Ensure affordability is tied to household income, not just below-market rates (e.g. 33% of income for low- and moderate-income households).
(3) Require that these units remain affordable for at least 25 years or more.
(4) Include these conditions directly in the zoning order and any related legal agreements with the municipality.
I urge the Minister to uphold or strengthen any existing or pending inclusionary zoning policies for the West Harbour GO area by ensuring this MZO requires affordable housing consistent with Hamilton’s transit-oriented planning goals. Developers should not be exempt from affordability rules in this high-priority transit zone.
This is a rare opportunity to secure meaningful, long-term affordability in a central and growing part of Hamilton. Given the ongoing housing and homelessness crisis in Ontario, it is essential that government tools like MZOs are used to guarantee real community benefit, not just speed up private development.
