James Seeley and Jennifer Spearin own PIN 49045-0117 (PCL 9-1 Sec 36M321; Summer Resort Lt 9 PL M321), PIN 49045-0116 (PCL 10-2 Sec 36M321; Pt Lt 10 PL M321, Pt 1 36R8277), and PIN 49045-0140 (shoreline). They plan to transfer PIN 49015-0116 to neighbouring lands described as PIN 49045-0115 (PCL 10-2 Sec 36M321, Pt Lot 10 PL M321, Pt 1 36R-8277) and PIN 49045-0138 (shoreline) to correct an accessory structure encroachment. There are no new buildings, services, or other developments planned.
Application 48-C-199936 was approved on June 18, 2019 with standard conditions. James Seeley and Jennifer Spearin have one (1) year to satisfy the conditions, otherwise approval will lapse.

The approval can be appealed using the procedure outlined below. Notice to appeal the decision to the Local Planning Appeal Tribunal must be filed with the Minister of Municipal Affairs and Housing on or before July 8, 2019.

Appeal process for decisions published before June 1, 2021
You can appeal all or part of this this instrument to the appeal to the Local Planning Appeal Tribunal (LPAT) by submitting a notice of appeal to the Minister of Municipal Affairs and Housing.
There is an additional “leave to appeal” right under the Environmental Bill of Rights.
Who can appeal
A notice of appeal can be submitted by:
- individuals
- corporations
- public bodies
A notice of appeal can’t be submitted by:
- an unincorporated association
- an unincorporated group
You can, however, submit a notice of appeal as a member of the unincorporated association or group.
You have to have made an oral submission at a public meeting or a written submission to the council before the official plan amendment was adopted. Note: this is not required if you are appealing a proposal for provisional consent (no official plan in place).

- the specific part, or parts of the official plan amendment that you wish to appeal
- the reasons for your appeal
- the appeal fee, payable by certified cheque or money order to the Minister of Finance, Province of Ontario

Description of instrument
Application No. 48-C-199936 seeks to sever approximately 0.03 hectares from 317 Marten Lake Road as a lot addition to 319 Marten Lake Road, which is described as Lot 10 on Plan 36M-321. The lot addition will correct the encroachment of a driveway and accessory building. Both the proposed severed and benefiting lands contain single dwellings and accessory structures and are privately serviced. Access to both lots is via Marten Lake Road. Both lots have frontage on Marten Lake.
